HBB Trial Update Extravaganza | part 1 karen straughan 2018-07-12 | Part one takes us on an exciting and rollercoaster-style journey from the first scheduled trial dates (in January of 2017? fuck it's been so long I can't remember anything other than driving 5 hours through a blizzard to get there) that were hijacked by an 11th hour motion for summary dismissal by the defence, right up until the weeks leading up to our final appearance in court this July. A second video detailing the even more shocking and absurd events of June 29 thru July 5 will be uploaded within the next 24 hours.For those of you asking to know what this trial is about:Alison is an independent female comic creator, with a graphic novel series called "Xenospora". In April of 2015, she rented a booth at the largest comic expo in western Canada, and asked some of us Honey Badgers to help man and run it. She designed and had made a Xenospora-themed custom booth installation that took 5 hours to install, that included a massive LED-lit "space funnel" and an 8' tall vertical Xenospora banner. Some of the people involved in the #gamergate conversation donated money to the fundraiser to get us other badgers there. As a hat-tip, she put a banner in the booth with a #GG graphic and the slogans "ethics" and "stand against censorship".At around 8AM on the first full day of the convention, a close friend and associate of Sam Maggs (an editor at The Mary Sue who was at the Expo), an associate who was in Toronto at the time, tweeted a photo of our booth and the banner. Complaints to the Expo began to pour in on social media, mainly from people who weren't even there, and we were summarily evicted without refund, and with only half an hour to leave before they said they would call the police to have us removed. Alison was also banned from all the Expos run by Calgary Expo (which was every Expo in western Canada) for 10 years.Taking down the installation without tools in such a rush caused thousands of dollars in damage to Alison's property. More than this, a 10 year ban is insane. At the previous Saskatoon Expo (also run by Calgary Expo), Alison was offered a job teaching at an art school in BC. Banning her from all the fan expos in western Canada is like blacklisting her from the marketplace.Calgary Expo has maintained right up until their single witness gave his evidence at the trial that we were evicted and banned because Alison engaged in harassment at a panel discussion on the first half-day of the convention, and that she had lied on her booth application (which comprises the contract between the parties). Allegations to this effect were published at The Mary Sue, a publication that not only didn't reach out to us for comment prior to publishing, but has never to this date done so. Those false allegations were confirmed by Calgary Expo's official twitter account. Dozens of both mainstream and industry publications took up the story from The Mary Sue. The only ones who reached out to us for comment were Kotaku and Breitbart. On the stand, the witness for Calgary Expo (the person whose decision it was to kick us out) testified that even had he known all the accusations in the complaints made on Twitter and elsewhere were false, he would still have kicked us out because of guilt by association and PR. He admitted this even after being reminded that unwarranted accusations are listed in the Expo's harassment policy as a form of harassment in themselves, and that the contract obligates the Expo to investigate all allegations to determine if they're false or unwarranted.Alison's professional reputation as an independent comic creator is tainted by dozens of articles that describe her business model as one where she lies on her contracts for the purpose of sneaking into events so she can engage in disruption and harassment.We are alleging that Calgary Expo breached its contract with Alison and engaged in injurious falsehood by tweeting The Mary Sue's article in reply to people asking why were were kicked out.We are alleging that The Mary Sue engaged in injurious falsehood by publishing falsehoods they knew or should have known were false or without taking proper care to check, and inducing breach of contract via the tweet by a close friend and associate of one of their editors that started the social media shitstorm that informed Calgary Expo's decision to breach our contract.
