Is It Time To Do Away With The Death Penalty In India? Scroll.in 2023-02-05 | Globally, India is in a shrinking minority as a country that retains the death penalty on its statute books. 145 countries do not use the death penalty. They have either formally abolished it or do facto not using it. The inability of the Indian criminal justice system to administer the death penalty in a fair manner has been repeatedly called into question. The Supreme Court too has acknowledged the problem and has entrusted the matter of reforming death sentencing to a constitution bench. We spoke to Professor Anup Surendranath, the lead writer of the Death Penalty In India Report that is a comprehensive and in-depth look at the manner in which the death penalty is administered in India. He tells us that of 100 death sentences that are handed out by the trial courts in this country, a shocking 35 result in acquittals over the course of their judicial lives. Overwhelming Majority Of Child Marriage Cases Prosecuted Are Of Girls Who Marry Of Their Own Choice Scroll.in 2022-12-28 | The Supreme Court is currently seized of two matters relating to child marriage and personal law. In one case the National Commission for Women plea seeks to raise the minimum age of marriage for Muslim women to be on par with persons belonging to other faiths. In the second, the NCPCR has moved the SC against a HC order that ruled as valid, the marriage of a 15 year old Muslim girl. The commission in its appeal says the order of at odds with POCSO- the Protection of Children from Sexual Offences Act which deems sexual intercourse with a minor, someone below 18 years of age, as sexual assault. The age of consent you would recall was increased from 16 to 18 years in 2013 to bring it in conformity with the then newly passed Protection of Children from Sexual Offences Act. Earlier this month the Chief Justice of India, echoing various high courts in the country, flagged the issue of criminalisation of romantic relationships between adolescents under POCSO, he appealed to Parliament to review the age of consent, something the govt has now said it does NOT plan to do. Meanwhile, child marriages in India have seen a steady decline but are even today, as per the National Family Health survey data, at a worryingly high 23.3%. We spoke to Madhu Mehra, founder of Partners for Law in Development to understand these interconnected issues.
