Officer Held was upset because he felt the owner wasn't providing prompt attention to him. During the argument, Officer Held flashed his badge and told the business owner that he was a Cheektowaga police officer.The owner told Officer Held to leave and the owner then filed a report alleging the use of a racial slur by Officer Held.The owner's wife confirmed the owner's claims of use of a racial slur. Officer Held's wife, who was also present, claimed that she didn't hear any racial slurs, and she made the inane claim "we have friends that are black" as if that is some type of vaccination against a racial slur slipping out of her husband's mouth.The CDP concluded that the racial slur allegation was "unsubstantiated" - stating (1) the owner's wife was "an interested party" (and apparently therefore cannot be believed), and (2) that it was simply a "he said he said" situation.No mention was made of the officer's wife being an interested party. And I wonder how many times town court has accepted an officer's statement over a citizen's statement in a "he claims he claims" traffic ticket case. But here's the most interesting aspect of the investigation - Oficer Held claimed he was upset because the owner left him standing outside the building for 8 to 10 minutes on a cold blustery day. He later said it might have been 4 to 6 minutes.
