Four hundred twenty-one days after the passing of Justice Antonin Scalia, the resulting vacancy on the Supreme Court has finally been filled. Following a controversial process which culminated in the Senate voting 54-45 to confirm, Neil Gorsuch was officially sworn in Monday morning as an Associate Justice on the U.S. Supreme Court. With President Donald Trump looking on, Justice Anthony Kennedy administered the oath to Gorsuch — who officially becomes the fifth Republican appointee on the Court. Gorsuch’s appointment was met with a great deal of controversy. Prior to leaving office last year, President Barack Obama nominated Merrick Garland to fill Scalia’s seat. But Senate Republicans refused to hold a confirmation hearing, and after winning the election, President Trump tapped Gorsuch for the spot. When Senate Democrats filibustered the nomination, Republicans in the chamber voted to employ the so-called “nuclear option” to override, and ultimately put Gorsuch on the Court.
The appointment of the conservative Gorsuch will likely not tip the balance of the Court — as he is replacing the Conservative Justice Scalia. But the Justices thought by many as being most likely to retire next are Ruth Bader Ginsburg, who is 84 and perhaps the Court’s staunchest liberal, and 80-year-old Justice Anthony Kennedy — generally considered to be a key swing vote.White House Press Briefing W Sean Spicer 3/9/17Live On Air News 22017-03-09 | At today’s White House press briefing, White House press secretary Sean Spicer was pressed on this issue by Fox News’ John Roberts, who asked Spicer if President Donald Trump was aware that Flynn was working as a foreign agent when he appointed him “I don’t believe that that was known,” the press sec noted. “I would refer you to General Flynn and to the Department of Justice in terms of the filings made.” Roberts followed up by asking him if Trump would’ve appointed Flynn if he had known, to which Spicer answered “that’s a hypothetical” but that it was his understanding that Flynn filed the “appropriate forms” and that Flynn should be asked directly about the situation.Sean Spicer RIPS Media For Double Standard When It Comes To Sources 3/6/17Live On Air News 22017-03-06 | Sean Spicer RIPS Media For Double Standard When It Comes To Sources 3/6/17Sean Spicer Responds To President Trumps Claims Of Being Wiretapped During Press Gaggle 3/6/17Live On Air News 22017-03-06 | Sean Spicer Responds To President Trump's Claims Of Being Wiretapped 3/6/17President Donald Trump and Prime Minister Netanyahu Press Conference 2/15/17Live On Air News 22017-02-15 | President Donald Trump is expected to welcome Prime Minister Benjamin Netanyahu to the East Room of the White House Wednesday, where the two world leaders will hold a joint news conference. Trump recalled the statute that gives the President the power of “suspension of entry or imposition of restrictions” on aliens. “Let me read something to you,” Trump said to the audience, “because you could be a lawyer, or you don’t have to be a lawyer; whether you were a good student in high school or a bad student in high school, you can understand this.” Trump then recalled the statute on “suspension of entry or imposition of restrictions by President.” The law states, in 8 USC 1182(f): Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.President Trump National Prayer Breakfast 2/2/17Live On Air News 22017-02-02 | President Donald Trump delivers speech at the National Prayer Breakfast 2/2/17. At 49, he will be the youngest Supreme Court nominee in 25-years. He is best known for upholding religious rights in court battles involving the Affordable Health Care Act (aka Obamacare). Gorsuch was appointed to the federal bench by President George W. Bush in 2006 as a member of the 10th Circuit Court of Appeals in Denver.
According to SCOTUSblog, Gorsuch “is celebrated as a keen legal thinker and a particularly incisive legal writer, with a flair that matches — or at least evokes — that of the justice whose seat he would be nominated to fill.” In fact, in a study called Searching for Justice Scalia: Measuring the ‘Scalia-ness’ of the Next Potential Member of the U.S. Supreme Court, Gorsuch earned high marks in several categories important to the late Justice Scalia, including “originalism” and “textualism.” Like Scalia, Gorsuch has gained notoriety for his lively judicial writing style
On Religious Freedom
As an appellate judge, Gorsuch participated in the high profile religious test cases of Hobby Lobby Stores v. Sebelius and Little Sisters of the Poor Home for the Aged v. Burwell.
Gorsuch argued the the conception mandate of the ACA (Obamacare) was a burden on the religious free exercise rights in violation of the Religious Freedom Restoration Act of 1993. In Little Sisters, Gorsuch took the position that the 10th Circuit majority failed to show sufficient deference to the tenants of the Little Sister‘s beliefs and the Supreme Court later mostly agreed with this decision — remanding it for a solution between the parties and the Court on how to accommodate the Little Sisters beliefs while still giving rights to employees to receive contraception coverage.Elizabeth Warren RIPS Betsy Devos. In the first official White House press briefing, White House Press Secretary Sean Spicer was pressed on the statement he made over the weekend about President Donald Trump’s crowd sizes at the inauguration. As you may recall, Spicer berated the press for how it reported on the size of the inauguration audience, telling the gathered reporters that “this was the largest audience to witness an inauguration. Period!” After many in the media ridiculed Spicer for presenting obvious untruths in his statement, White House counselor Kellyanne Conway defended him, saying he was giving “alternative facts.” After starting the presser with a joke about his statement, Spicer took several questions at the beginning unrelated to the controversy. Jonathan Karl of ABC finally broached the subject, asking Spicer about if he’d promise not to tell a lie while at the podium. “Is it your intention to always tell the truth from that podium,” Karl asked. “And will you pledge never to knowingly say something that is not factual?” Following Spicer stating that it should be a two-way street with the media and stating that when someone issues a correct it can show they weren’t trying to deliberately mislead the public, Karel then asked Spicer if he wanted to issue any corrections. With the press sec telling Karl to ask away, the ABC correspondent brought up the metro ridership, which was one of the key things that Spicer used to state that Trump’s inauguration crowd size was greater than Barack Obama’s in 2013. After Spicer said he gave the numbers he was provided at the time, Karl then pressed Spicer to answer if he was willing to stand by his claim that the inauguration was the most-watched. “Sure, it was the most watched,” the secretary exclaimed. “One network alone got 16.9 people online. Tens of millions watched it online. Nevermind the audience that was here. 31 million people watched it on television.” Karl then said he didn’t want to get into numbers, with Spicer countering by saying “I do!” The press secretary then proceeded to rattled off a list of numbers with Karl unable to counter as it was apparent he didn’t have any on hand to come back with. Spicer would continue to hammer away at the press in the back-and-forth, bringing up the Martin Luther King bust flap. Watch the whole exchange above. Jon Karl asks Sean Spicer if he vows to never "willingly lie" to the press which Sean Spicer agreed. Spicer then went on to explain the set of "facts" he was working with Saturday which led him to make the claims he did on crowd size. jon karl during first press briefing: "We have to be honest with the American people... jon karl asks sean spicer "is it your intention to be truthful from that podium?" President Donald Trump delivered a very populist inauguration address, declaring to the American people, “This moment is your moment. It belongs to you.”
He thanked his predecessor Barack Obama and Michelle Obama for their “gracious aid throughout this transition.”
He touched on the big issues he wants to tackle in office, from bringing jobs back to America to securing the borders, before saying, “A new vision will govern our land. From this day forward, it’s only going to be America First.”
Trump also made some pretty strong calls for unity:
“We will discover our loyalty to each other. When you open your heart to patriotism, there is no room for prejudice. The Bible tells us how good and pleasant it is when God’s people live together in unity. We must speak our minds openly, debate our disagreements honestly, but always pursue solidarity. When America is united, America is totally unstoppable.”
He said that no matter a person’s race or religion, “we all bleed the same color of patriots, we all enjoy the same glorious freedoms, and we all salute the same great American flag.”
“You will never be ignored again,” the president declared. “Your voice, your hopes, and your dreams will define our American destiny, and your courage and goodness and love will guide us along the way.”
And Trump concluded by saying, one more time, that “together we will Make America Great Again.”Donald Trump Pre Inauguration Dinner FULL Speech 1/19/17Live On Air News 22017-01-20 | President-elect Donald Trump spoke at a pre-inauguration donor dinner tonight and said that “This was a victory for all of us.” But during the speech Trump went down what you could describe as his greatest hits list from the campaign season, from swiping at the media (i.e. “A couple of ’em are starting to get honest”) to recounting the scene on election night. He riffed a bit on his Cabinet appointments, said “the other side is going absolutely crazy,” and insisted that he’s satisfied with each person he’s chosen (and would tell people if he wasn’t). He thanked his family and people like Reince Priebus and Kellyanne Conway––the latter of whom briefly joined the president-elect on stage. He praised Conway and said that “when my men are petrified to go on a certain network,” she goes on and “destroys them” instead.
Trump kept hitting upon the theme of people doubting he would make it this far, declaring, “I outworked everybody.”Donald Trump Deploraball Inauguration Dinner FULL SpeechMichael Moore FULL Speech at Anti Trump NYC Protest 1/19/17Live On Air News 22017-01-20 | Michael Moore at Donald Trump NYC Protest FULL Speech 1/19/17Alec Baldwin Does Donald Trump Impression At Michael Moores Donald Trump NYC ProtestLive On Air News 22017-01-20 | Alec Baldwin Does Donald Trump Impression At Michael Moore's Donald Trump NYC ProtestDonald Trump Pre Inauguration Concert FULL Speech 1/19/17Live On Air News 22017-01-19 | Donald Trump Pre Inauguration Concert FULL Speech 1/19/17. Days before leaving office, Obama commuted the majority of Manning’s 35-year prison sentence over her stealing and leaking of government documents. Manning is now scheduled to be released from prison in May. Reuters’ Jeff Mason asked POTUS if this sends a message that leaking docs won’t generate a harsh sentence and how he can reconcile the commuting of the sentence in light of Russian hacking and WikiLeaks’ part in it. He also wanted to know if WikiLeaks’ Julian Assange would be arrested or charged if he came to the United States. In response, he noted that Manning needed to take responsibility for her crime and that the punishment that she received was disproportionate to what other leakers have received. He discussed whistleblower protections and how many may have legitimate concerns about about the actions of their governments and agencies. As far as Assange, he largely brushed off both him and WikiLeaks, saying he hasn’t paid attention to Assange’s comments, hasn’t commented on WikiLeaks regarding Russian hacks and would refer everyone to the Justice Department on criminal investigations. He further noted that “in light of all the circumstances that commuting her sentence was entirely appropriate,” once again referring to Manning. In The final Press Conference of his presidency, President Barack Obama explained his decision for Chelsea Manning's Commutation. Elizabeth Warren (D-MA) grilled Rep. Tom Price (R-GA) — Donald Trump’s nominee for Health and Human Services secretary — over his proposal to cut to cut funding for Medicare and Medicaid, as well as his introduction of legislation that directly benefitted a company he held stock in. Noting that more than 100 million Americans receive healthcare through the federal programs Medicare and Medicaid, Warren asked Price if he hopes to cut Medicaid funding by more than $1 trillion dollars, as his 2017 budget proposal suggests. Price did not directly answer whether he proposed the trillion dollar cut, instead arguing the “metrics” of success for Medicare and Medicaid are “not necessarily the amount of money” put into the programs. Warren refused to let Price dodge her question. “It’s a yes or no,” she pressed. “Did you propose to cut more than a trillion dollars out of Medicaid over the next ten years?” “You have the numbers before you,” Price shot back. “I’ll take it as a yes,” Warren replied. The Massachusetts senator then referenced Donald Trump’s campaign pledge not to cut funding to Medicare and Medicaid, asking Price if he can “guarantee” he “will safeguard president-elect Trump’s promise” regarding funding for those programs. Price, once again, dodged the question. “Your question presumes that money is the metric,” Price began. “I’m sorry to interrupt but we’re very limited on time,” Warren replied. “The metric is money.” “Frankly, the millions of Americans who rely on Medicare and Medicaid today are not going to be reassured by your notion that you have some metric other than the dollars that they need to provide these services,” she continued, noting “Americans will be watching” to see if Price reneges on Trump’s campaign promise. Warren then pressed Price about his stock holdings in Zimmer Biomet, a medical device manufacturer that made several contributions to Price’s reelection campaign. In March 2016, six days after purchasing stock in Zimmer Biomet, Price introduced legislation in the House that directly benefited the company. Warren took issue with Price’s argument that he was not the one “making those decisions” to buy stock in the company, noting the HHS nominee did not use a blind trust or passively managed mutual fund. “So let’s just be clear, this is not just a stock broker, someone you pay to handle the paperwork,” Warren began. “This is someone who buys stock at your direction. This is someone who buys and sells the stock you want them to.” “Not true,” Price said. “Because you decide not to tell them” Warren asked. “Wink, wink, nod nod, and we’re all supposed to believe that?” The Massachusetts senator then asked Price directly if he took actions to benefit a company he owned stock in. “I’m offended by the insinuation, senator,” Price replied.Elizabeth Warren GRILLS Tom Price at Senate Confirmation Hearing 1/18/17. Senator Elizabeth Warren (D-MA) blasted Donald Trump's nominee to become Secretary of Health and Human Services over his desire to drastically cut essential services, including Medicare and Medicaid. Warren reminded Rep. Tom Price (R-GA) that Donald Trump himself promised he would not cut those core safety net programs. After informing Rep. Price "more than 100 million Americans now receive their healthcare through Medicare and Medicaid," Sen. Warren reminded Rep. Price the budget he authored as chair of the House budget committee would have cut spending on Medicaid by $449 billion over the next decade, and would have cut Medicare by more than $1 trillion Price's response? The "metrics" used to determine success of these programs should not be dollars. That prompted a heated exchange, with Senator Warren slamming a combative Price, then reminded Rep. Price that "President-elect Trump was very clear about his views on Medicare and Medicaid." "Can you guarantee to this committee that you will safeguard President-elect Trump's promise and while you are HHS Secretary you will not use your authority to carry out a single dollar of cuts to Medicare or Medicaid eligibility or benefits?" Warren asked. "What the question presumes is that money is the metric," Price responded. "In my belief from a scientific standpoint, if patients aren't receiving care even though we're providing the resources, it doesn't work for patients." Warren was not buying what Price was selling. "We're very limited on time," she reminded the nominee. "The metric is money. And the quote from the President-elect of the United States was not along this to cut dollars from this program. So that's the question I'm asking you. Can you assure this committee you will not cut one dollar from Medicare or Medicaid should you be confirmed to this position?" "I believe that the metric ought to be the care that the patients are receiving," Price insisted. "I'll take that as a no," Warren retorted.Bernie Sanders GRILLS Tom Price at Senate Confirmation Hearing For HHS 1/18/17Live On Air News 22017-01-18 | Bernie Sanders grilled Tom Price at The Senate Confirmation Hearing for HHS Secretary. Senator Cory Booker today got a lot of attention for testifying against Senate colleague and Trump AG nominee Jeff Sessions in what he called a matter of conscience but what more cynical observers felt was his kickoff to a 2020 presidential run. Booker acknowledged at the outset today just how extraordinary his testimony is (more on that here), but said, “In the choice between standing with Senate norms or standing up for what my conscience tells me is best for our country, I will always choose conscience and country.” Leading up to his testimony today, there were reports highlighting Booker’s praise of Sessions last year when the two senators came together to award the congressional gold medal to Selma marchers. He said at the time he felt “blessed and honored” working with Sessions on it. Booker acknowledged this in his remarks today, but he maintained that he believes his colleague has shown “hostility” towards certain aspects of criminal justice that he believes are important for the U.S. attorney general to hold.
He said Sessions would not be a leader in tackling racial bias in police departments across the country at a time when America needs more “hope and healing.”
One of the biggest reactions to Booker’s speech circulating on Twitter was that he was using it to raise his national profile for a presidential run:Donald Trump Shouting Match With CNN Reporter At Press Conference You Are Fake News 1/11/17Live On Air News 22017-01-11 | Donald Trump OWNS CNN Reporter At Press Conference "You're Fake News" 1/11/17. Spicer hit the publication for releasing what he described as false and salacious information. “It’s frankly outrageous and highly irresponsible for a left wing blog that was openly hostile to the president-elect’s campaign to drop highly salacious and flat-out false information on the internet just days before he takes the oath of office,” Spicer exclaimed. He continued, bringing up Buzzfeed’s Ben Smith’s letter to the staff: “According to Buzzfeed’s own editor, there are some serious reasons to doubt the allegations in the report.” The Trump spox further claimed this was all an effort by Buzzfeed to drive traffic to their site, while also invoking CNN’s report on the delivery of a two-page synopsis.
