According to Civil Rights Litigation Group, " They can’t lie in every instance, and they can’t fabricate evidence (Florida v. Cayward, 1989), but most of the time it’s completely legal for them to lie so it’s important to remember this if you are ever interrogated. The Supreme Court ruled in Frazier v. Cupo (1969) that police officers can lie during an investigation as long as it does not “shock the conscience of the court or the community.” For instance, they can’t tell someone that they will lose custody of their children if they don’t confess (Lynumn v. Illinois, 372 US 528 (1963). But they most certainly can lie about a lot of things that can intimidate people into confessing to crimes they didn’t commit. And as long as the court determines that a confession was voluntary and not obtained through violence, the court could allow it."

The situation was NEVER anywhere near being "out of control."
The officers in this video are Bradley Nash and Jacob Amos of the Bisbee Police Department. Amos is the one who asked me to move.
Both were involved in the attack against me in the park with the skunk. Bradley Nash was one of three who attacked and Jacob Amos showed up after, asked me a question and took a video that was later deleted.
There were also two agents from Border Patrol who showed up to the take the folks away.
I don't mind officer safety, but I do not like when they conjure (paranoid) reasons to abridge our First Amendment Right to Freedom of Speech and Press.
The situation was actually very peaceful and calm. If anyone was "getting out of control," it was Amos.
Cops work very public jobs. They are paid by public tax dollars and activities that occur in public can be documented. The public's right to film cops is a well established First Amendment Right.

This is not the first time Joseph D. Estes has issued empty threats. He also threatened "legal action" against me if I did not remove and retract information within 24 hours of his demand. I ignored Joe's bizarre request. My lawyer contacted him and said to NOT contact me.

To this day, City of Bisbee Police refuse to release audio and video relating to the
June 10 incident in Vista Park with the former Animal Control Officer,
stating videos and
audio from the incident are "protected information."
I was able to gain access to this information from the County Attorney.

The body cam footage in this video is minutes after I was tackled by Carlos Moreno, Nash, and Defoor when the Animal Control Officer, Dolores Luberto, flipped out because I was filming police tyrants and called in what appears to be a false police report.
During the incident, I suffered head trauma and I actually do not remember the conversation in this video as I was in need of medical treatment at the time. I was diagnosed with a concussion at the hospital later that day.

Officer Amos is also in this video asking where I work. All Officer's involved are Bisbee Police.
For nearly 3 months now, the shady City of Bisbee has refused to release this video to me. I eventually obtained it from another source. Thanks to the City for absolutely nothing. You people make me sick. I've never met a bunch of people who lie as much as you. This whole mess is like they say about Nixon, the cover up is just as sick as the incident.
I do have a very strong lawyer and we are moving forward with our lawsuit.

Just a bit of house cleaning, since crazy commenter "Wild Women" is spreading false lies about me, I'd like to clarify that I'm NOT James Nolan. I don't know who that is. Wild Women is nuts.
On Aug. 11, the "outside agency" said this, "County Attorney has the file, but it has not been reviewed whether we will take it or not. "
I believe Theresa Coleman is using double speak to purposefully mislead the public.
She is not awaiting a "complete review", they are awaiting an initial review to know whether or not the outside agency will even take it or not.
Now two months later, this was literally the first public statement she has made for herself about the fiasco.
Meanwhile, the violent officer (Carlos Moreno) who led the attack against me is STILL patrolling our streets as if nothing ever happened
The Animal Control Officer is fresh off her 2 month tax payer sponsored vacation, an apparent reward for bizarre and dangerous behavior, and now she is probably looking for some other little town to do the same damn thing, and we wonder what's wrong with law enforcement in this country?

The City of Bisbee and Bisbee Police have been having a real difficult time releasing information related to the skunk
incident despite multiple public records by local media based on the communities interest.
It was written that the report would be over 170 pages long, so when I saw the City Attorney, James Ledbetter, walking
down the street I decided to ask him about it.
Ledbetter went on to inform me that the report is actually over 700 pages long! That's more than many novels!
It is my belief that the Bisbee Police have created this huge report in order to confuse and distract everyone from the
cover up that is taking place and as a way to stall the investigation. Cops investigating themselves is a huge problem
all over the country, and this is an example of why we need more oversite.
Now more than 2 months from when the incident took place and for all the public knows about this situation,
the Animal Control Officer is STILL on paid leave!
So that's pretty much the story, a government worker totally fucks up everything, causes a camera person to be
attacked for no reason, and she gets the biggest paid vacation anyone can think of. And we wonder what's wrong?
Everyone should be concerned. This is government corruption. It's a cover up intended to fool the public.
Don't worry though, I have retained a very strong lawyer and we are currently waiting on my medical treatment to conclude before we move forward with the lawsuit.
Sergeant R. Shupe of the Arizona Highway Patrol pulled me over at around 10:45 AM and gave me a warning for "Driving on one lane and improper lane change," which is not true.
