And the reality is pretty straightforward.
AdvisorShares Pure US Cannabis ETF (NYSEARCA: MSOS) is down over 51 percent. ETFMG Alternative Harvest ETF (NYSEARCA: MJ) is down nearly 48 percent. Amplify Seymour Cannabis ETF (NYSEARCA: CNBS) is down more than 63 percent. Even broader exposure vehicles like Cambria Cannabis ETF (BATS: TOKE) are shutting down altogether.
But within that same environment, one ETF has held up better than the rest.
AdvisorShares Pure Cannabis ETF (NYSEARCA: YOLO).
Not because it’s been strong — but because it’s been less weak.
That difference comes down to structure. YOLO isn’t fully tied to U.S. multi-state operators. Instead, it includes names like Village Farms International (NASDAQ: VFF), High Tide Inc. Texas regulators have finalized a rule that will force smokable hemp THC products off retail shelves by March 31, 2026. The rule was adopted by the Texas Department of State Health Services following a public hearing process that generated more than 1,400 public comments.
Beginning next year, retailers in Texas will no longer be allowed to sell products such as THCA flower, pre-rolls, live resin, rosin, or other smokable hemp THC products.
The change stems from Texas adopting a “total THC” calculation, which counts THCA toward the legal THC limit. Once THCA is included in that formula, most smokable hemp products exceed the allowable threshold, effectively removing them from the legal market.
Edible hemp products such as gummies and THC beverages will still be allowed, but they will now face stricter testing, packaging, and licensing requirements.
Texas has been estimated to represent a multi-billion-dollar hemp market, with a significant portion of that revenue coming from smokable products, particularly THCA flower.
For operators, investors, and policymakers, the move could signal how other states may approach the intoxicating hemp loophole moving forward.

According to reporting first published by Marijuana Moment, the Florida Supreme Court has rejected an appeal from the Smart & Safe Florida campaign, effectively ending the effort to place adult-use cannabis legalization on the state’s 2026 ballot.
The campaign needed roughly 880,000 valid signatures to qualify for the ballot but ultimately fell short after tens of thousands of petitions were invalidated by state officials. The court also stated that it would not entertain a rehearing, meaning the path for a 2026 vote is now officially closed.
While the headline may appear negative at first, the broader reality is more nuanced. Florida remains one of the most important cannabis markets in the United States—even without adult-use legalization.
The state’s medical cannabis program is already estimated to generate roughly $2 billion annually, with continued growth as the patient base expands. Major multi-state operators including Trulieve Cannabis Corp. (OTCQX:TCNNF), Curaleaf Holdings, (TSX:CURA), and Verano Holdings (CBOE: VRNO)(OTCQX: VRNOF) all have major exposure to the state through its medical market.
With Governor Ron DeSantis term-limited and unable to run again, many observers now believe 2028 may represent the next realistic window for Florida voters to revisit adult-use legalization.

According to reporting first published by The Marijuana Herald, Donald Trump is expected to sign an executive order later this year creating a federal commission tasked with studying the full descheduling of cannabis.
If such a commission were formed, it would examine the legal, economic, regulatory, and public-safety implications of removing marijuana entirely from the Controlled Substances Act. That would go beyond the current federal rescheduling process, which aims to move cannabis from Schedule I to Schedule III.
For the cannabis industry, the distinction is significant. Rescheduling could bring major changes such as relief from IRS rule 280E and expanded medical research opportunities. Descheduling, however, would represent a far larger shift by removing cannabis from the federal drug scheduling system altogether.
According to the report, the proposed commission would include roughly a dozen members and would deliver a formal policy recommendation to the White House and Congress within about six months of being established.
While the proposal would not immediately change federal law, it suggests the conversation in Washington may be beginning to expand beyond rescheduling and toward a broader debate over the long-term future of federal cannabis prohibition.

We begin in Florida, where the state Supreme Court rejected an appeal from marijuana legalization advocates attempting to restore invalidated ballot signatures. The decision effectively ends the campaign’s effort to place adult-use cannabis legalization on the 2026 ballot, closing the door — at least for now — on what many believed could have been one of the largest potential cannabis markets in the United States.
We also look at new reporting suggesting that leaders from the hemp and marijuana industries may be finding some common ground on federal policy priorities. With cannabis rescheduling still under review in Washington and Farm Bill negotiations continuing in Congress, some stakeholders believe a more unified industry position could influence how cannabinoids are regulated moving forward.

The issue traces back to the Agriculture Improvement Act of 2018, which legalized hemp federally by defining it as cannabis containing less than 0.3% delta-9 THC. While the law removed hemp from the Controlled Substances Act, it also created what many now refer to as the “hemp loophole.”
Because the legislation focused only on delta-9 THC, companies were able to sell intoxicating hemp-derived cannabinoids such as delta-8 THC and high-THCA products. Over time, that loophole helped create a multi-billion-dollar hemp cannabinoid market sold across smoke shops, convenience stores and online retailers nationwide.
Now lawmakers are moving to tighten those rules by shifting to a “total THC” standard, which would count all forms of THC rather than just delta-9.
At the same time, Washington is moving closer to federal cannabis rescheduling under the Controlled Substances Act.
With hemp regulation and marijuana policy reform unfolding simultaneously, the next phase of cannabis regulation in the United States could be shaped by how these two policy tracks intersect.

There’s a lot riding on what happens in this bill on how hemp-derived cannabinoids will be regulated.
Then we turn to Michigan, where the cannabis market is dealing with growing political pushback. Eight bipartisan state senators are now moving to repeal the state’s newly implemented 24% cannabis wholesale tax, which was layered on top of the existing excise and sales taxes.
Adam Stettner, CEO of FundCanna joins us to outline that tax was projected to generate roughly $421 million annually, but early numbers suggest operators are already feeling the pressure.
January dispensary sales fell 8.3% year-over-year, even as product volume reached record highs — a clear sign that operators are selling more cannabis for less money in one of the most competitive markets in the country.

Massachusetts has been raising eyebrows in recent months after a proposal surfaced that would effectively roll back legal marijuana sales in the state. But the latest polling data suggests the outcome may already be clear: voters overwhelmingly oppose the idea of reversing legalization.
A new statewide poll shows roughly two-thirds of Massachusetts voters oppose the ballot initiative that would repeal legal cannabis sales, while only about 20 percent support it. The numbers reinforce what many in the cannabis industry have argued for years — once regulated markets are established, public appetite for reversal tends to disappear.
Massachusetts legalized adult-use cannabis in 2016, and since then the market has generated billions in legal sales, hundreds of millions in tax revenue, and thousands of jobs across the state.
The controversy surrounding the proposal has also intensified after surveys suggested that many residents who signed the petition may not have realized the measure was aimed at repealing legal marijuana sales. Some respondents said the petition was framed around unrelated issues such as housing or public safety.
Regardless of how the initiative reached this stage procedurally, the broader takeaway appears clear.
Nearly a decade after legalization, Massachusetts voters show little interest in turning the clock back on the regulated cannabis market.
