Paul D. Werner, Esq.
Member, Buttaci, Leardi & Werner Law Firm, Princeton, NJ
At the April 2019 AMMG CME Conference in Miami, Florida Werner discussed critical information and effective mitigation strategies for the most common compliance risks threatening age management physicians and their practices. These include: HIPAA/HITECH privacy and security requirements, including enforcement initiatives of the Office of Civil Rights; and Corporate Compliance issues, including OIG enforcement of the Stark law, the Anti-kickback Statute, and relevant state-based statutes and regulations. The focus of this workshop will be risk management and liability avoidance through internal policy development, self-auditing, and other proactive risk prevention strategies. The Stark law, the Anti-kickback statute, and the Anti-Inducement provisions of HIPAA are a source of confusion for most lawyers, lets alone physicians.
