On April 5, 2024. An off-duty Dane County Sheriff’s Deputy called dispatch to report a suspected drunk driver dangerously driving. The deputy also reported that the individual got out of their vehicle and began punching the off-duty’s Deputy's vehicle before driving off. An officer from the Oregon Police Department located the reported vehicle and conducted a traffic stop. The driver was identified by his driver's license as Allan. He stated that someone had been following him and when he went to approach this person's vehicle, the individual would not talk. Allan then advised that he left and denied punching the other vehicle. Officers smelled the odor of alcohol and asked Allan to step out of the vehicle. Field sobriety tests were conducted and it was determined that Allan would be placed under arrest for OWI. He was transported to the Oregon Police Department and agreed to submit to an intoximeter test which showed he had a BAC of .04. An officer explained that just because he blew under the legal limit did not mean he couldn't be charged with OWI. The officer said under the totality of the circumstances that he would be receiving a citation for OWI, operating left of center, and disorderly conduct. Allan was able to call someone who was willing to pick him up and was able to be released from the police station. He was found guilty for Disorderly Conduct and Operating Left of Center. His Operating While Intoxicated charge got dismissed and he was ordered to pay $678 in fines.
