This video introduces the separate sovereigns exception to the double jeopardy clause of the Fifth Amendment and its upcoming challenge in the Supreme Court. In Gamble v. United States, the Supreme Court will decide whether to overrule its own precedent and hold that the Double Jeopardy Clause prohibits the federal government from prosecuting a person for the same act that subjected him to prosecution in state court.
