The case understands that Netflix has the "right to have an unpleasant character in the series,” but argue "should have given the character a fictitious name and changed the character’s identifying details so that no one would believe that the character was a portrayal 'of and concerning' the real Rachel Williams." The documents go on to outline Rachel’s argument that they could have given the part another name. They state that "given the easy alternative of protecting her by using a fictional name, the decision to use her real name evidences Netflix’s intent to harm her reputation, thereby justifying the imposition of punitive damages, especially if Netflix made that decision because Williams had sold her rights to the rival Sorokin project being developed by HBO." Brought up in Leeds, Robinson lived for most of his adult life in Canada. When he created the fictional Dales market town of Eastvale as the setting for the first DCI Banks novel, Gallows View (1987), his primary aim was to stave off homesickness. The disturbing intrusion of brutal murder into the books’ drowsy countryside backdrop was a formula that Robinson deployed successfully for decades. Even those who had never tramped the Dales found themselves transported there by Robinson’s evocative writing, and latterly he gained a large international audience. Dennis Lehane acclaimed the Banks novels as “chilling, evocative, deeply nuanced works of art”; Stephen King hailed “the best series of British novels since Patrick O’Brian”. Robinson was far from an overnight success, however: “in the mid-90s I was dumped by my US publisher and barely had my head above water in the UK,” he recalled in 2019. His determination to make Banks an “ordinary everyman” meant that the character was initially overshadowed by more flamboyant coevals such as Morse, Rebus and Dalziel. It was his unshowiness, however, that his admirers appreciated. “Banks’s … very ordinariness makes him all the more convincing,” asserted The Times’s crime critic Marcel Berlins in 2005. “Robinson’s (and Banks’s) quiet style has perhaps led to his being underrated; but make no mistake, he’s among the very best.” Robinson’s fortunes began to turn in 2004 when his new publisher Hodder & Stoughton, who had poached him from Pan Macmillan in a rumoured £1.4 million four-book deal, began an aggressive marketing campaign. Readers began to fall for Banks in the hundreds of thousands. Part of the appeal of Banks – a London copper who had transferred to Yorkshire for a quieter life only to find the Dales lousy with corpses – was his buttoned-up nature, with readers keeping on buying the books in the hope of getting to the bottom of his character. As the years passed Banks was promoted to superintendent, but became ever more dour as his marriage failed. “However, while he has become more of a loner, he hasn’t lost his sense of idealism,” Robinson declared in 2010. “Despite his flaws, it’s that moral core which makes him attractive, I think, to readers.” Robinson was always admired for his skill in constructing plots, but the books also became more engaged with serious issues as the series progressed. When The Music’s Over (2016) – which took Robinson, normally a book-a-year man, two years to write – was much admired for its ambitious interweaving of storylines involving two topical themes: a celebrity who exploits his fame to prey on underage girls (inspired by Jimmy Savile, a prominent figure in Leeds when Robinson was a teenager), and Asian grooming gangs. What linked the cases, Robinson noted, was the harm caused by “other people or institutions who might have known what was going on but never said anything and did not follow up on allegations”. His profile received a further boost with DCI Banks, an ITV drama with Stephen Tompkinson in the lead role, which ran for five series between 2010 and 2016. It was well-received, but most of the episodes were original stories rather than dramatisations of Robinson’s work, and, as he observed, “most of my long-term readers didn’t like the TV series much … They have their own ideas of what [Banks] was like.” Robinson admitted to little similarity between himself and Banks, except for their eclectic taste in music. “I don’t think I could do his job, be a policeman. I don’t like the sight of blood for a start. Emergency services were called to Darley Street in Sale at 3.30 pm where they gave immediate assistance to the two individuals. Despite the efforts of those on the scene, the man could not be saved. Police said his family have been informed and are being supported by specialist officers. Jessica, a student at Wolfreton School, Willerby, died while swimming in a lake near the city of Limoges in July 2015. The teachers on the school trip were accused of manslaughter by gross negligence. Prosecutors had called for Steven Layne, Chantelle Lewis and Daisy Stathers to be jailed for three years. On Wednesday, they were found not guilty. Jessica's elder sister Hannah Davison, 33, has now spoken of the family's devastation at the verdict, saying that her family didn't get the answers they wanted. 'We hoped that this would be the week that we finally had some answers and were able to begin the process of moving on with our lives but that hasn't happened, which is impossible to accept,' she said. 'Until someone is held accountable for Jessica's death we will never be able to process what happened to her. It simply can't be the case, in those circumstances, that a young girl with her whole life ahead of her died and it's no one's fault.' Her parents Tony and Brenda Lawson had hoped the trial of the three East Yorkshire teachers would bring answers to the question that had been haunting them for seven years: how and why did their daughter die. The devastated parents were seen in floods of tears on the steps outside the Palais de Justice in the French town of Tulle after the verdict was delivered on Wednesday. Tony, overcome with grief, had immediately walked out of the courtroom as the teachers were acquitted. 'My parents are broken, completely devastated and their lives will never be the same again,' Ms Davison said. 'But with a different verdict from this case at least they could have started to make some sense of it. With a verdict and some answers you can then begin to put things in place to make sure it doesn't happen again. 'But when the court declares 'no one's to blame, it's just one of those things' you can't do that,' she continued. Ms Davison said that has her own children now - aged five and seven - who go to school in the same authority. 'How could I ever send my kids on a school trip? How could I ever trust anyone with the care of my children when I'm not there? 'All parents at some time or another have to hand over the care of their children to professional people and we need the confidence everything is in place that possibly could be in place to ensure they are safe. 'This was not the case for Jessica. Over in France the local mayor had been made aware that the pontoon needed to be secured in a very particular way and it wasn't.' Jessica, who was the youngest child on the trip from Wolfreton School in Willerby, near Hull, became trapped after a pontoon capsized. More than 20 children had climbed on to the orange plastic platform, which was designed for less than half that number when it collapsed, flipping over as it did so. 'There were too many children on the pontoon and it took too long for anyone to notice Jessica was missing,' Ms Davison said. 'You had a young lifeguard on duty who had not only the children to watch but other holidaymakers who were visiting the lake, that's a lot of people.' Hannah is also furious with East Riding Council, who she says have never shown support to the family. She said: 'My children go to school in the same local authority area. How can I trust they will be kept safe when they are away from me. I know for certain they will never be going on any school trips run by that authority. Ms Davison said that while the lives of those on trial would go back to normal, that would never be the case for her family - especially her parents, who moved to Portugal to escape from the 'constant reminders' of what happened. 'The teachers will now go back to their jobs after the case. They've never even been the subject of an internal disciplinary procedure. Everyone else's lives will return to normal apart from ours, as a family we're further away from understanding the truth than we've ever been. Garfield Balfour, 50, had been driving the Route 35 TfL bus on Walworth Road when he struck Arthur Gowrie, 88, after he stepped into oncoming traffic. Dramatic CCTV footage showed Mr Balfour leaning down to the ground to collect a wrapped chocolate bar with his hands removed from the steering wheel, while Mr Gowrie could be seen falling into the road. Despite the best efforts of the emergency services and members of the public, the pensioner died of his injuries two days later in hospital. The court heard that at 4:16pm on August 2, 2019, Balfour was driving an out-of-service bus down Walworth Road when they approached traffic. While travelling at a rolling speed at 0mph, he made the “conscious decision” to remove his hands from the steering wheel and lean forwards to retrieve the chocolate bar. Prosecutor Wayne Cranston-Morris argued that at the same time, he “moved the vehicle forward” by pressing the accelerator pedal with his foot. Another CCTV clip showed Mr Gowrie standing at the curbside with his walking stick and shopping trolley, before stepping into the road and walking in front of the bus, before he was knocked to the ground. Branding it an “extremely unique case”, his defence lawyer Elizabeth Lambert said that the accident was an “unfortunate combination of events carried out at the same time that the defendant had no control over”. She argued that Mr Gowrie was in the driver’s blindspot and crossed the road in a way “that many drivers would not have anticipated”. Ruling out the possibility of a custodial sentence, Judge Nigel Peters KC said: “All cases involving death on the road are sad and are ones in hindsight where things could have been different. We all know how dangerous it is as a driver or a pedestrian on the roads and statistics show a huge number of people suffer death, personal injury or accident on busy roads such as the Walworth Road where this occurred, where traffic is moving at slow speed and where pedestrians, cyclists and all other road users are darting in and out of busy streets. “This tragedy occurred on August 2 at 4pm in broad daylight and nothing we can say or what counsel say can repair a situation where Mr Gowrie, tragically 80 years old, was making his way home. We've seen on the tv he has a walking stick and a shopping trolley and he's waiting at the curbside as so many people do, not going to the nearest traffic lights or crossing and taking a chance to cross the road when traffic had become stationary. “And traffic was stationary. Garfield Balfour has been driving London buses since 2016 with an impeccable record. No one suggests he set off that, doing anything more than his job and doing his job properly. But as we've seen from the CCTV, there was on his part a decision which he made which hugely contributed to what happened. “He decided in slow traffic, he stopped, the foot was on the hand brake, he made a conscious decision to help himself to a chocolate bar which was on the floor. He did so by looking down and away from his normal vision, picking his chocolate bar up from the floor. Traffic started to move and very slowly he moved from handbrake to accelerator.” He continued: “No one suggests this defendant did anything deliberate to injure harm, far from it. Sadly Mr Gowrie fell over and because of his age, he fell in such a way as to hurt his head and he did not survive sadly.” While his defence lawyer had argued against the mandatory licence disqualification, Judge Peters said: “The camera tells us what happened in his case, he made the conscious decision to distract himself. The Prime Minister made a passionate defence of her plan to get Britain booming again, hitting out at the "anti-growth coalition" looking to derail her vision for the country. After a somewhat tense and febrile atmosphere during the conference in Birmingham over the pat four days, Ms Truss was cheered by party members as she promised to "get our economy growing". She also received a standing ovation after Greenpeace protesters disrupted her speech shortly after she started speaking. Making the case for her growth plan, Ms Truss said: "Economic growth makes us strong at home and strong abroad and we need an economically sound and secure United Kingdom and that will mean challenging those who try to stop growth. "I will not allow the anti-growth coalition to hold us back. "Labour, the Lib Dems, the SNP, the militant unions, the vested interests dressed up as think tanks, the talking heads, the Brexit deniers, Extinction Rebellion and some of the people we had in the hall earlier. "The fact is they prefer protesting to doing. They prefer talking on Twitter to taking tough decisions. "They taxi from north London townhouses to the BBC studio to dismiss anyone challenging the status quo. "From broadcast to podcast, they peddle the same old answers. It's always more taxes, more regulation and more meddling." Former Cabinet ministers Michael Gove and Grant Shapps have been the most vocal critics of Ms Truss during the conference meeting in Birmingham. In a swipe at those attempting to undermine her premiership, the Prime Minister said: "I know how it feels to have your potential diminished by those who think they know better." The Tory party conference has been marred by internal bickering as senior Conservatives criticised Ms Truss's economic plan. The Prime Minister was forced to ditch her plan to scrap the 45p top rate of tax after a growing number of her own MPs threatened to vote against it in the House of Commons. "I get it and I have listened," Ms Truss said as she took responsibility for the error in her speech today. "The fact is the abolition of the 45p tax rate became a distraction from the major parts of our growth plan. That is why we're no longer proceeding with it." After suggestions of a rift between No10 and No11, the Conservative leader also heaped praise on Kwasi Kwarteng. She was "in lockstep" with her "dynamic" Chancellor and the pair were working together to unleash the potential of the UK. She said: "Cutting taxes is the right thing to do morally and economically. "Morally, because the state does not spend its own money. It spends the people's. "Economically, because if people keep more of their own money, they are inspired to do more of what they do best." The project sees black and mixed-race women recreate their school photos with their natural hair, after research found that almost a third of black women concerned about their hair missed out on school picture day. “When it came to school picture days, I used to try and chemically straighten my hair to try and fit in with the Eurocentric ideals of beauty at the time. “It’s taken me some time to get there but, since then, I now embrace my afro and wear it unapologetically.” Dove’s research found that 84 per cent of black and mixed-race women felt the need to alter their natural hairstyle for school. There have been a number of high-profile cases of race-based hair discrimination in the UK. In 2020, a schoolgirl won £8,500 in an out-of-court settlement against a secondary school in east London after she was repeatedly sent home because of her hair. Research suggests children who drink energy drinks regularly are more likely to suffer from insomnia and headaches, and develop behavioral problems and perform worse at school. But while most parents recognize brands like Monster and Red Bull as energy drinks, experts warn gaming supplements could be mistaken for a protein shake because they are diluted in a gym shaker bottle. And while mainstream energy drinks have a finite amount of caffeine in them, tubs like G Fuel allow children to quickly refill and get their next hit. ‘[Kids] might not understand the risks and benefits of these types of things,' Dr Atul Malhotra, a professor of medicine at the University of California, San Diego, told DailyMail.com. In their search for scenarios that could explain the Earth-moon system we know today, researchers at Durham University’s Institute for Computational Cosmology, simulated hundreds of different impacts using the AMD powered supercomputer. They varied the angle and speed of the collision as well as the masses and spins of the two colliding bodies in a bid to create different scenarios. The calculations were performed using the SWIFT open-source simulation code, run on the DiRAC Memory Intensive service (Cosma), hosted by the university on behalf of the DiRAC High-Performance Computing facility. The extra computational power revealed that lower-resolution simulations can miss out on important aspects of large-scale collisions. Only the high-resolution simulations produced the moon-like satellite, and the extra detail showed how its outer layers were richer in material originating from the Earth. According to the researchers, if much of the moon formed immediately after a giant impact, this could also mean less became molten during formation than in the standard theories where the moon grew within a debris disk around Earth. The researchers suggest that depending in the details of the subsequent solidification, these theories should predict different internal structures for the moon. Co-author of the study, Vincent Eke, said: “This formation route could help explain the similarity in isotopic composition between the lunar rocks returned by the Apollo astronauts and Earth’s mantle. “There may also be observable consequences for the thickness of the lunar crust, which would allow us to pin down further the type of collision that took place.” Researchers found that even when a satellite passes so close to the Earth that it might be expected to be torn apart by the “tidal forces” from Earth’s gravity, it can not only survive but also be pushed onto a wider orbit, safe from future destruction. Lead researcher of the study, Jacob Kegerreis, said: “This opens up a whole new range of possible starting places for the moon’s evolution. “We went into this project not knowing exactly what the outcomes of these very high-resolution simulations would be. “So, on top of the big eye-opener that standard resolutions can give you wrong answers, it was extra exciting that the new results could include a tantalisingly moon-like satellite in orbit.” It is thought the moon formed following a collision 4.5 billion years ago between the young Earth and a Mars-sized object, called Theia. Most theories see the moon created by gradual accumulation of the debris from this impact. However, this has been challenged by measurements of lunar rocks showing their composition is like that of the Earth’s mantle, while the impact produced debris that comes mostly from Theia. Experts say upcoming lunar missions should reveal new clues about what kind of giant impact led to the moon, which in turn will tell us about the history of Earth itself. His successor - Prime Minister Moeketsi Majoro - declared a state of emergency in August, after legislators failed to pass two bills meant to end political volatility in parliament. The boys passed by with victims in their arms.” At least 125 people were killed in the crush on Saturday following the game between his side and Persebaya Surabaya in the city of Malang.Panic-stricken fans died in the crush as they desperately tried to flee the stadium after police fired tear gas into crowds who ran onto the pitch at the end of the domestic league match. Distraught family members were on Monday struggling to comprehend the sudden loss of loved ones at the match that was watched only by the home fans of Arema FC. Witnesses said fans flooded the pitch and demanded that Arema management explain why, after 23 years of undefeated home matches against Persebaya, Saturday night’s ended in a 3-2 defeat. Some of the 42,000 Arema fans threw bottles and other objects at players and soccer officials. At least five police vehicles were toppled and set ablaze outside the stadium. Two police officers were among the dead. But according to witnesses most of the deaths occurred when riot police, trying to stop the violence, fired tear gas, including toward the spectator stands, triggering the disastrous crush of fans making a panicked, chaotic run for the exits. Most of the 125 people who died were trampled upon or suffocated. Muhamad Dipo Maulana, 21, who was at the match, told BBC Indonesia that Arema fans went on the pitch to confront home team players but were immediately intercepted by police and “beaten”. More spectators then took to the pitch in protest, the supporter said. “Police with dogs, shields, and soldiers came forward,” he said adding he heard more than 20 tear gas shots toward fans. Reflecting on Sarah's tragic death, Cheryl said she wants to remember her friend's 'fun' side from before her cancer diagnosis, rather than the 'darker' times from when Sarah was terminally ill. 'Although memories of that time do exist and are hard to shake, they hold no weight against the light she so brightly shone in the years beforehand.' The singer said she has many more happy memories of their friendship to focus on, rather than Sarah's illness, adding that she wants to remember her friend's 'fun, bubbly and deeply soft' personality instead. Cheryl also revealed that she spent some of Sarah's last days with her, where she said they 'laughed and cried' together while reminiscing about their friendship. She said: 'In the last few days spent with her, we got to laugh, cry, reminisce, cook, watch spiritual programmes (our shared love) and pray together, those are the parts I will keep in my heart as I let the illness recede into the background.' Cheryl also spoke about the moment she found out about Sarah's cancer diagnosis, saying her friend told them while they were planning celebrations for Girls Aloud's 20th anniversary. She admitted she felt completely helpless and numb when Sarah told her about her illness, saying she tried to help however she could, by sending care packages including Sarah's favourite items. Cheryl previously told MailOnline that Sarah's last wish was for her bandmates to create a gala in her memory, leading to them planning Sarah's Primrose Ball. Sarah's Primrose Ball is due to take place at The Londoner Hotel on October 8 and will be hosted by Fearne Cotton and feature performances from Olly Alexander, Ricky Wilson and Chrissie Hynde. Funds raised at the gala dinner will go to the Sarah Harding Breast Cancer Appeal research project, which will be conducted by Sarah's oncologist Dr Sacha Howell. Despite being a relatively obscure character, Figment's passionate fanbase means a number of attempts to remove 'Journey Into Imagination' - or at least reduce his presence - have fallen flat. Currently, he's the star of the current version of the ride, which has been retitled 'Journey Into Imagination with Figment'. The attracted sees the dragon guide park visitors on a tour of the five senses, helping people understand the impact everything has on your imagination. The core skills of A&R remain, he says, but “we have way more data points”. In a business dominated by streaming and social media, turnover of music is fast and furious. There is far more of it to sift through in search of gold. On the video-sharing platform TikTok, tracks and sounds bubble up constantly, and can cause an A&R stampede if they are generating views and shares – but 30 seconds of virality does not make a career. “The industry can get very excited about something going viral, but it’s not necessarily the sound that’s going viral, it’s the content, and the music is secondary,” says Dipesh Parmar, president of Sony subsidiary Ministry of Sound Records. “That’s where you’ve got to use your gut and listen to the music. That’s where A&R is key.” Virality has ephemerality baked in; what is trending today can tarnish tomorrow. Take Nathan Evans, who was signed by Polydor Records, part of Universal Music Group, in January 2021 based on a social media sea shanty trend. Within a month, his song Wellerman was No 1 in the UK. Since then, however, he hasn’t troubled the charts. This stands as a moral for the TikTok age: chasing trends can just lead to dead ends. Parmar gives examples of the different ways Ministry has discovered hit acts or tracks recently: Paul Woolford’s Looking for Me came via the long-established demo route, he was signed “on a gut feeling” then fed to traditional media and streaming before the song gained a life of its own on TikTok; Secrets, a 2020 collaboration between Regard and Raye that has been streamed nearly 350m times, was built from a 30-second clip that Raye made. Sometimes, though, discovery for A&Rs can still be surprisingly analogue. “We signed Ewan McVicar’s Tell Me Something Good last year because we heard it on the dancefloor, rather than on [social media or SoundCloud],” says Parmar of the 2021 hit. “Because we heard a track on the dancefloor, he was able to quit his job in a factory and is now a full-time artist.” Competition between A&Rs to sign acts is ferocious, but relying too heavily on data is a doomed enterprise. “It’s easier to find the artists, but then it is so much more competitive because everyone’s looking at the same data,” says Parmar. Jeff Bell is international general manager at Partisan Records, home to Idles and Fontaines DC. He says things are moving at hyperspeed today, which creates new challenges for the industry. “Culture moves quicker than any business model can keep up with,” he says. “But it’s certainly not algorithmic in the work we do.” Acts today are signed primarily for their music but often with an eye on how social-media literate they are and how adroitly they market themselves. As such, there is mounting suspicion around just how “organic” viral effects are, with suggestions that some acts, from huge pop stars to indie acts that aim to project credibility, are gaming the algorithms by using microinfluencers to boost their profiles. A&Rs will, publicly at least, argue that short-term successes just set bombs under long-term prospects. Yet there remains a culture of omertà here, where every successful A&R seems to want to keep their cards close to the chest. For example, the team behind PinkPantheress, an artist who deftly used TikTok to build an audience and land a deal with Parlophone, part of Warner Music Group, is not keen to talk about its process. Today, the divide between A&R departments and marketing departments has diminished. “Part of the signing process is being able to identify audiences and potential audiences,” says Bell. “That is a core function of the marketing team here as well. It’s not just that the lines are blurred; they are essentially part of the same team.” Kentish says acts typically put out an album’s worth of music on singles and EPs before they get to their debut album proper, their A&R strategy effectively playing out in public and in real time. “It feels like they are making their difficult second record, but it’s their first record because they’ve put out so many pieces of music that document that first period of their artistry,” he says. “That traditionally would have been their first album.
