Auditors/Cop-watchers Ismael Rincon ("Corner News"), Matthew Rankin ("hbomatt") and Brandon White ("America First") and Melanie Trimble ("Blue The Blue Line Watcher") were charged with a misdemeanor and indicted on felonies. All charges were dismissed. They then sued for 1983 civil rights violations, and lost on summary judgment concerning qualified immunity. The case just went up on appeal. I provided my commentary on the deposition of Officer Barker, who prepared the declaration to get the search warrant over a misdemeanor charge of making a false report. This deposition involves a sergeant and original responder, Bogany. He could not name the elements for the misdemeanor crime he investigated. He was honest. The police kept the cell phones of two persons for 22 months. $105K bonds were imposed, forcing them to spend time in jail before the funds could be raised. There is more to this story. The attorney who took the deposition (Brandon Grable) runs a channel called "Clearly Established." Two 911 calls from the same apartment were made about Matt carrying a sidearm, which he was legally allowed to do. The first call - a woman - said she was "offended." Police arrived. The cop admits that Matt did not commit a crime. In a bizarre twisting of the statute, they claim a fake emergency was generated by the Plaintiffs, even though the misdemeanor charge only applies to the person calling it in. Stated differently, criminal charges were brought when no crime existed. The issue may turn instead on the existence of probable cause.
