Wow, ATF’s Pistol Brace Rule Blocked By Federal Appeals Court, Issued Temporary Injunction Colion Noir 2023-05-24 | ATF Pistol Brace Injuctionbit.ly/2CHLudtThe 5th Circuit Court of Appeals has just granted an injunction against the ATF's pistol brace rule in the case of Mock v. Garland.For those who are unfamiliar, the 5th Circuit of Appeals covers Louisiana, Mississippi, and Texas. They play a crucial role in the judicial system, reviewing appeals from lower courts to ensure the fair and correct application of the law.Their decisions have significant ripple effects, shaping how the law is interpreted and enforced within their jurisdiction.However, it is not clear whether this injunction applies only to the plaintiffs or also to the people within the jurisdiction of the 5th Circuit Court or anyone who owns a Maxim Defense firearm with a brace and members of FPC.It is also unclear whether the injunction applies nationally.Currently, the ATF rule requires anyone who owns a gun with a pistol brace to either remove and destroy it or register the braced firearm with the ATF and pay a tax before May 31.Failure to comply with this requirement could technically result in a felony charge and potential arrest.However, this injunction prevents the ATF from arresting people until the appeals court makes a ruling on the rule, regardless of whether it is before or after May 31.In short, as long as this case is ongoing, the ATF cannot enforce their brace rule. It still has enough power to stop an aggressive 800lb Grizzly bear if the shooter is able to aim accurately.For many people, the 10mm caliber is considered the "Goldilocks" round (lol you get it??), as it is big and powerful enough to do the job of defending against bears, but not so big and powerful that it becomes difficult to shoot or limited to specific types of firearms like revolvers or low-capacity semi-automatics.Two years ago, I made a video discussing whether the Glock 20 is the ideal bear gun. Yet, a 13-year-old was able to commit the same damage with a handgun as a 33-year-old former security guard armed with an AR-15.Not only did a 13-year-old cause the same carnage using handguns, but he did it in a country with gun laws that are stricter than those in the US.Our anti-2A politicians in the US want us to believe that if we let them pass what they like to call "common-sense reasonable gun laws," they won't try to go further if there's another shooting. However, we only need to look at what Serbia did in response.Serbia already had all the gun laws our politicians are trying to pass, and more.Serbians have started handing over firearms, ammunition, and "pieces of mines and explosive devices" following President Aleksandar Aleksandar Vučić's May 5 announcement of "almost total disarmament."There is no such thing as common sense reasonable gun control because what they consider common sense and reasonable will forever be a moving goalpost.Today they say banning AR-15s is reasonable. But handguns are used more than twice as often in mass shootings compared to AR-15s.Once there's another mass shooting, they will be telling us that banning handguns is common sense and reasonable, just like Serbia is doing now.The irony is that the school shooter in Serbia didn't acquire the guns because there wasn't a law preventing him from obtaining them, the shooter stole the guns from his father.Hypothetically speaking, if the shooter in Texas couldn't get an AR-15 because they were banned, he would have used a pistol instead.As we can see with the shooter in Serbia, who killed more people with a handgun than the shooter in Texas did with an AR-15, the carnage would have been the same.Yes, Serbia doesn't have as many mass shootings as the US, but they also have a fraction of the population.There are over 300 million people in the US, while Serbia has 6 million.It's common sense to expect more shootings in a country with a significantly larger population comprising diverse ethnic groups, cultures, and beliefs living in close proximity to each other in densely populated cities, compared to a country where a major ethnic group makes up over 80% of the population.Gun violence is a complex issue, which is why politicians try to oversimplify the solution by defaulting to gun control.It's understandable since gun control gives them exactly what they want—more control. Well, sometimes, another citizen with a gun can be your first responder.I have always felt that people standing with their back to the world in front of a box that spits out money if you push the right buttons is a robber's wet dream. That's why I avoid using ATMs as much as possible. To me, it's like putting a sign on your back saying, "Please rob me."I love the fact that an armed citizen was able to come to the rescue of another person. Nobody ever talks about these types of situations, but they happen more often than you think.That's why the most recent Second Amendment Supreme Court ruling was so important.It essentially gave the right to carry a gun for protection and the protection of others to people who live in states where their government made it virtually impossible to get a concealed carry license. A lot of these defensive gun use stories happen in pro-gun states because the people in these states are allowed to carry a firearm.You don't hear about these defensive gun use cases in anti-gun states because the only people who have guns on them are the criminals and the police. The main stream media ignore stories about citizens with guns defending themselves and overload you with stories of criminals victimizing citizens because they want to sell you the illusion that you can only be a victim and can't defend yourself against criminals.Having a population of legal gun owners doesn't stop the police from doing their job, but gun control does stop citizens from being able to effectively protect themselves.Speaking of protection. Now, I'll admit, I wasn't in the courtroom, and maybe there was evidence or testimony that made the Jury believe his life wasn't in danger.Still, I'm also not naive enough to think that this case's social politics didn't play a role in this decision. How much of a role, I can't say, but I do know Austin is essentially a mini California, run by a very Woke Mayor who hates guns in the hands of civilians.The protestor was an avid supporter of Black Lives Matter and was there with his black disabled wife, while the driver was not a supporter of the protest.None of this should matter because the only questions that needed to be answered were, did the driver have a legal right to be where he was?Did the driver engage in any actions that would justify using deadly force to stop him from engaging in that action? Finally, did the driver reasonably believe that his life was in immediate danger, which would justify using deadly force to protect himself?But Juries are composed of people, and people are inherently biased, so you may think what you did was justified. Still, your justification and someone else's justification may differ.Hell, your justification may not be the same as what another state may consider be justified.
