Second attempt at FOIA Request Right2Resist 2024-10-29 | Second attempt at records request. I was given the name of the two sheriff's deputies that assisted Deputy Mathis in his unlawful arrest. Funny enough, I was given this information by the very first local cop I saw a block up the street. They are tired of Mathis, and they don't like bad supervisors who enable him.We are returning to file the complaint on Sergeant Steinle for violating Colorado statute that requires him to allow individuals to film officers in the course of their duties on the side of the road. Even if his invalid claim of interference held weight, he did not follow Colorado statute and give the person recording sufficient time to leave the area of the traffic stop.Both Deputy Steinle and Deputy Mathis violated the provisions of Colorado State bill SB 20-217 which was passed and enacted by the legislature in 2023. Deputy Brown also violated these Provisions by refusing to intervene when Mathis and Steinle unlawfully arrested the person recording and using his presence recording as the unlawful basis for a probable cause statement of interference with a police officer. All three of these offenses by the deputies are valid reasons to revoke P. O. S. T certification and require retraining to re-enable it.

The same deputy lied about this traffic stop back in May Right2Resist 2024-10-26 | This was the previous interaction from sometime in May. I was driving the same vehicle that Deputy Mathis pulled over on 10/21. Marhis said that I was going 81 in a 65. I had two different people observe my speed before stopping at 70. I also had traffic in front of me preventing me from going any faster te han 70. The deputy is a liar. This interaction proves that this incident is RETALIATION. The deputy did not like being talked to that way. But everybody in this town already knows this deputy. And they already know his reputation. It's time to hold people accountable.
Sheriffs deputy Sgt. Steinle arrests man for recording in public. Right2Resist 2024-10-24 | The individual recording was called by their significant other and told that they were being pulled over while having committed no traffic infractions. The individual recording listened to deputy Mathis asking leading questions pertaining to vehicle registration and asking for the phone number and email address of the significant other of the person recording. The person recording parked 150 ft behind the traffic stop in the highway easement and entrance to private property. He walked down the public highway easement onto public right-of-way in order to record the completion of the traffic stop. The person recording made no attempt to speak to the driver or the deputy. The person recording was twice the agreed-upon distance away as discussed in various Colorado First Amendment rulings regarding recording traffic stops. Deputy Mathis immediately escalated the situation as is seen on video. The individual recording even moved far enough back to be behind the deputy's vehicle giving clear distance to complete the stop. Upon arrival of a secondary deputy Brown, the person recording stayed in the immediate vicinity of the secondary deputy giving the primary deputy the time to complete their traffic stop. Deputy Mathis ignored their duty to complete the stop and release the driver and instead proceeded to discuss how to arrest the individual recording with a Sergeant Steinle that arrived on scene. The person recording moved even farther back until the rear of their body was touching the vehicle of Deputy Brown. Giving at least 150 ft of distance between the person recording and the vehicle under detainment. Sergeant Steinle walked up and asked the person recording to come speak to him at his patrol vehicle. The person recording had not been told that they were being detained in any way and was on a public easement and had no obligation to follow the orders of anyone. The person recording politely inquired to Sergeant Steinle why he needed to follow him. The sergeant attempted to tell the person recording that failure to do so would be interfering with the traffic stop happening 150 ft in front of this conversation. The person recording again reiterated that they were far enough away from the detained vehicle as to not be interfering. However, he was interrupted mid-sentence and was told that he was going to be arrested for obstructing a police officer.The person recording knows the law very well.According to Colorado State statute.18-8-104“Obstruction of a Peace Officer is charged whenever a person: “Uses or threatens to use violence, force, physical interference or an obstacle, and such person knowingly obstructs, impairs or hinders the enforcement“As is clearly evident from the video. At no time did the person recording attempt to obstruct the peace officer or use violence or threatened to use violence.According to CO SB 20-217 passed in July of 2023, it becomes a crime for officers to interfere with a person who has a constitutional right secured by the Bill of Rights of the Colorado Constitution that is infringed upon by any peace officer to bring civil action for the violation. A plaintiff who prevails in the lawsuit is entitled to reasonable attorney fees and a defendant in an individual suit is entitled to reasonable attorney fees for defending any frivolous claims. Qualified immunity is not a defense to the Civil action.The act also requires a peace officer to intervene when another officer is using unlawful physical force and requires the intervening officer to file a report regarding the incident. If a peace officer fails to intervene when required the P. O. S. T. shall decertify the officer.The ACT also makes it unlawful for any governmental authority to engage in a pattern or practice of conduct by peace officers that deprives persons of rights, privileges, or immunity secure to protected by the Constitution or laws of the United States or the state of colorado.Additionally, case law such as Irizarry v. Yehia establish a clear and present understanding by Colorado court systems of the individual right to record police. Not only is the behavior of the deputies involved in this case reprehensible but the behavior is illegal. Both by Colorado state standards and by federal law enforcement standards.According to 18 USC 242, which is titled "deprivation of rights under color of law", it is a crime to intentionally deprive someone of their rights, privileges, or immunities protected by the Constitution or laws of the United states. It is not required that the offense was motivated by racial bias or any other animus, and the fine and punishment is up to 1 year in prison and $1,000 fine.Case law, state law, and federal law sit with the person recording. This person will be asking the judge for a summary dismissal of the charges with prejudice. Along with a specific letter notifying the Attorney General of the actions of Deputy Mathis, Brown and Steinle.
